Yes, in a democracy no one is above the law. Not police, not politicians, not judges, and not even the president. People in power tend to forget this. Because they pass the laws, or are charged with enforcing them, they feel they aren't accountable to them. They are wrong.
The judge broke the law. He should be treated as any other offender. In fact, that's the law. I don't know what is S.O.P. for police in these situations, but I have a hard time believing they normally just issue citations, rather than make arrests, when they encounter someone carrying an illegal substance. The press needs to stay on this story and make sure the justice system applies equally to this judge, too.
No, I don't think judges necessarily should be held to a higher standard, but they certainly should be required to follow the laws of the land just like everyone else. If found guilty, their sentence should be no less or no more than anyone else would receive.

I read this this morning and laughed my butt off. as much as i think smoking pot is ok, i have to say that judges, and cops and ANYONE who enforces the law should obey the laws.
I'm married to a cop, and he's so by the book and I respect that. he loves his job. he doesn't even drink. i think that being any other way in a job like that would be hypocritical. i even gave it up because he can't be around that crap, but if he wasn't a cop...i'd totally smoke.

Well...itis desirable, if you set yourself up to judge your peers. But there are some laws out there that are just plain silly. Of course, the idea of a judge running around robbing people is ridiculous, but it's not the end of the world if he goes 5mph over the speed limit, is it?

i know a judge who has violated the jay walking regulation back home. she wasn't arrested but given the special treatment.

Dude, this judge is now my IDOL... Sitting under a tree, blazing up, minding his own biz... And, he will have the book throw at him, unfortunately. Any idea where to send donations for his defense fund? Or, at least where to send a few blunts?
