He is just about to rob £1200 off me for tax I have already paid. This means I have just worked as a Healthcare Assistant at my local hospital during my time off (evenings and weekends) - after I have finished my highly stressfull office job, for nothing. I will tell them, again that I have already paid, but if I do get some of it back I will still have to wait a month or so. Anyone had a similar situation?

Its from a self assessment 04-05 when he was employed but they are assuming he was self employed I think. It was that long ago we dont have the payslips etc and had a falling out with the employer. oh yeah and they slapped on £200 late penalty fee because we couldnt afford to pay on time! Tw*t.

It sounds like what is termed as a 'determination' of tax. This is where an estimate of the tax due is made, usually £500 for a balancing payment, £250 for each payment on account and then late filing penalties.

These amounts are subject to change only when you submit a Tax Return for the year. Do that, and the £1200 will be automatically adjusted accordingly. Even if you pay the amount, you will still be chased for the Tax Return.

I really don't understand why people get annoyed with HMRC. HMRC can only work with the information they are provided with....if they have the wrong information give them the right information so they can sort this mess out for you.

Tax Inspectors are only doing their jobs, I think that people refer to the 'tax man' like its a person who gets kicks by making people's lives a misery.

All Tax Inspectors do is interpret and enforce the law - if they make mistakes they are often the first people to admit it.

If they don't there is a nice little group of people in each City called the 'General Commissioners.' If you think that the amount you are being assessed on is incorrect - make an appeal against the assessment or the penalty (if you are within the time limits, which in this case it sounds like you are unfortunately out of time) and the GC's will decide.

All the Tax Inspectors I know are decent people so please don't call them b*****ds. Its impolite and simply downright rude.

As an ex-HMIT whose parents were not married, I can empathise. Maybe you could give us some more details and we could suggest a solution?

I agree with Tor - speak to HMRC in a calm way - they are not out to rip you off, only to collect the correct tax from you. It sounds form what you say that you had a late filing penalty for 04-05 when you were an employee and not self employed. In order to cancel that fine, you have to submit a self assessment.
If you are finding this hard to cope with, go to the CAB who will guide you.

If you have already paid you should be able to show that you have and not pay any more. If they can't find it maybe you did not correctly reference it - give them as many details as you can. If you talk to them reasonably there is no reason you should have to pay this second amount.
Re the fall out - the employer would have had to provide a P45 - even if you had a disagreement. this will have all the necessary details on. The HMRC should also have a copy of the P45 if it was sent to them. (I have claimed a rebate fromt he revenue even though I lost my copy of the P45)

Where did you pay it - did you ask them for a BR form when you took on the additional job? have you been paying tax and nic on 2nd job? You will be taxed higher if you have two jobs and if you have working tax credit for the full time job you will loose it because of the second job. If you have been wrongly taxed and will be it back you will get your tax code adjusted for next tax year.

Can't you prove that you have laready paid this tax? If not then you are probably stuffed.
