Insurance and hit a child beside an ice cream van. He doesn't seem to think it is serious. I am worried sick. I have phoned the hospital and the child is ok and has been sent home. Please help. I think he will get a custodial sentence He just seems to be burying his head in the sand.

He's going to get a nasty awakening! Just look at the offences he's committed:
Theft of your car
No licence
No insurance
Speeding
Possibly Dangerous Driving, certainly Careless Driving
I agree, he's going to go inside.
Glad you're dumping him, this bloke is a prat!
PS nothing to worry about on your part, you've clearly told the police he didn't have your permission. Good for you.

I'm not a lawyer however you will need to watch out. I sold a car and well..I found out that things can still happen to you if you don't take precautions. IE.
1. If the car is in your name, you are responsible for the accident in if the kid's family sues. As you are the liable owner. I found that the DMV record and all issues follow whomever is the registered owner.
2. You should check with your insurance company for what it will cover and how much.
3. Make sure your explain that all faults should lie with your partner not you. Get the police report on the case.
4. Dump the partner. or report that the partner stole your car to alieviate some of the fault from you.

Car taken without your knowledge or approval, this is theft. Unlicensed to drive is an offence, hitting the child, is termed reckless driving causing bodily harm, in my country.
As the police already knows, you only have to make a statement to enable them to investigate the case. The law will take its course after that. You have nothing to worry about. The insurance companies (for your car, your friend and the child's parents) will deal with any claims beween them). Thank the Lord the child is ok.

This is absolutely not your fault - do not feel guilty for his arrogance. If you have reported it to the police and made a statement saying he took the car without consent then you will not get into trouble. He needs his head looking at. I'm not sure where he'll end up as the law is very unreliable these days.

Your partner should be your ex., He has broken the law not you, so long as you've made a statement stating he took the car without your permission then as such you have nothing to fear, There is a very good chance he will get a custodian sentence, unless he has a very good defence. The one and most important thing is the child is going to be OK . My advice to you would be make him your ex asap, and find a decent man

If you were in my country, you would still be charged with contributory negligence for the following reasons:-
1. Not having a licence for your car and still letting it on the road.
2. Leting an incompetent person take control of your car.
and probably a host of other reasons which might arise frfom a close analysis of the facts of the case.
I strongly recommend you talk to a lawyer for a dvice while it's still early befor eht e child's family seek a remedy for the injury.

Obviously, he is a bit of crazy and insane.
Your partner may not get a custodial sentence and he will jail.
Although hitting a boy is not a serious, the police may charge him driving car without licence

Report the vehicle as stolen, or at the very least unauthorized use. Your insurance will probably still have some liability even then since he is your partner. This is one of those rare cases when you probably do need to consult with an attorney for legal advice.

Many people make mistakes, but when it comes to running down a child, your partner wont' have a leg to stand on. If he had a drink before then he will certainly go away. No sympathy, he was speeding - that and he was unfortunate...But then so was the innocent child.
