If you go to court and get a court order then he will need to comply. But, depending on the company doing the tDNA tests, the probability of them testing him overseas are slim to none since they aren't going to Iraq to get their sample. DNA tests are a very controlled test and need to be for obvious reasons. The military is not going to get mixed up with all the baby's daddy's messes that are out there unless you have a court order telling them they need to get him to do something. This sort of thing is a common practice and in more than a fair share of cases the man does not turn out to be the father. The military learned a long time ago to stay out of business like this unless the law is involved. Get a lawyer, go to court, get a court order. Depending on your state, if you collect welfare, food stamps, WIC, Medicaid, what ever from the state and list him as the father they will eventually force a DNA test so they can get their money back for taking care of your child financially. It sucks, but life without a husband in this situation makes things harder than it should be for the baby and for you.

With him being in Iraq all you can do is start the court proceedings but because of the Soldiers and Sailors Relief Act it can not go to court until after he gets back in the states. The blood that is on file will not be used for that it is to ID them if something were to happen to them.

As mentioned you will need that court order. Also if I recall correctly the blood on file at the Army's DNA repository was collect for the sole use of identifying dean soldiers and for no other reason. Therefore even a court order will not allow you access this blood for any reason.

You can get a military court order for a blood test but I am not sure how not having him take it before he left will play in court.
There are hospitals in Iraq to have the blood drawn for testing. Try the family services & see if they can help. If you are married, you do not need a paternity test as all babies born in bounds of marriage belobg to the husband.
Only a court can order a paternity test.

You need to get a hold of his command. Tell them you have his baby. He is not supporting you. He can get in a lot of trouble for not supporting his dependence. Don't feel bad about doing it. Supporting that baby won't come out of his pay check. The military pays for your children and spouse separate from base pay. His command should help you. As long as your 100% sure it's yours. Tricare should pay for the paternity test. I think it is how it works.

you cannot do anything without a court order. and since he is in Iraq, the courts will put a stay on it and you will not be able to proceed until he returns.
