The constitution spells out a requirement that prevents unreasonable search and seizure. The cases heard before courts throughout our legal history define it more narowly. The courts have always held that in order for a lawful search and seizure to take place, there must be a warrant to search describing the particular place to be searched and the particular items to be seized. The search warrant exceptions have already been discussed in your previous question. It is my opinion that this concept is violated daily by police along interstates in all states, when they stop motorists and ask if they can search there vehicle. Most drivers say o.k., without miranda warnings. These warning are crucial because the average person does not know they can say no and compel the police to get a warrant based on probable cause.

The Amendment guards against unreasonable searches and seizures, and was originally designed as a response to the controversial writs of assistance (a type of general search warrant), which were a significant factor behind the American Revolution.

the police must have reasonable suspicion to search your car, that means if they smell weed then they can search the car, or if you are acting suspicous or refuse a search of your car, they can run a dog around your car and if the dog hits on anything then they can search your car anyway
