I have been sued for 7500 dollars in small claims court in MN. I was traveling down the interstate and attempted to switch lanes. The driver of the vehicle behind me(in my blind spot) and definately going over the speed limit swerved to avoid me. I was apprx. a foot into the other lane. No vehicle contact was made. He swerved into the median, came back onto highway, and back into median, crashing into the cables seperating the interstate. HIs uninsured car was totalled. My insurance company is claiming I am 35% responsible and is not going to pay for his vehicle loss since he is at fault. Will my insurance company pay for any judgement against me in small claims court? I have full coverage.

Yes they should. That is why you pay for full coverage. In honesty though, it was your fault, I think your insurance company should pay 100% of it. I hate when people get in my blind spot also however you have to turn your head and LOOK in it before and as you start merging. If you hit a parked car, it isn't the parked car's fault is it? Nonetheless though that is the reason we carry insurance so you shouldn't worry, that is exactly what full coverage is designed to protect you against.

Nah, it doesn't work that way. The insurance company can't say you're not at fault and then leave you dangling in the wind". They should be dealing with this lawsuit, not you.

It's quite possible someone is preying on your lack of knowledge of the insurance business. Call your agent and be a royal pest until they handle it.

you did cause the accident,but i believe you insurance will pay,but you will have to pay your deductable,small price for totaling some-ones car.
