Doesn't matter the state, if they have a drug policy in place and they want to test you by what ever the means is stated in their policy they can. It can be as many times as the policy allows. Usually they will only test you either with a random test or at initial employment. However, from my experience, they will only test you once in a while unless there is suspicion or there was a positive test and they are confirming it. Some companies have drug policies that require employees to have a drug test any time they are injured or have an accident on the job.

They will get a way with hair follicle testing till they piss off the wrong person and they file a lawsuit for invasion of privacy, It is none of any company's business what a person was dong a do a year, two years or even fives years ago as long as they pass the required federally mandated drug test. I personally if I am asked to take a hair follicle drug test I will tell them to **** themselves and then I will heading to a attorneys office and filing a lawsuit for invasion of privacy

Most companies have a drug testing policy and they can do it anytime they want.... If you don't like it, quit.
