The other day some kid was racing down the street and lost control of his car smashing my retaining wall at the end of my driveway proceding to hit a tree in my front yard, take the steps off the front of my house and went threw a fence on the side of my house as well. When he hit the rock wall at the end of my driveway the rocks hit my house making several cracks and holes in different parts of the siding. They are not going to be able to match the color of the siding because its a few years old and faded. Is the driver's insurance company responsible for re-siding my entire house, or just the segments that were damaged? My concern is I bought the house in april and want to sell it in a few years, and it's going to look stupid with different color siding. Not to mention the kid driving didn't even have a license, and it was his mom's car. Thanks for the comment's in advance.

Most of the answers are close to being correct. I've worked in claims for the last 7 years. On any property damage claim, the liable party owes you "Actual Cash Value" of your damages, meaning replacement cost of repairs of the damaged property, minus depreciation OR the cost to repair the damaged property, which ever is less. This means that if you can replace 1 side of siding-which is technically a repair of the entire home's siding "system"-cheaper than the full replacement cost of the whole house minus depreciation, that is a valid option.

Keep in mind that while standing at any one side of the house, you can't see the other sides at the same time. All siding will fade, but different sides of the house have different exposures to the sun and fade at different rates. Right at this moment your siding on one side doesn't match the other sides.

However, any construction company can in fact find almost any siding that is only a few years old, AND there is a national company called Sidingmatch.com which can find it for sure. Once it is installed back onto your house, you will not be able to tell after a year or so. You have the right to ask the auto insurance for the vehicle owner to go through that process to get your house back to pre-loss condition.

One last thing, if you really did have some crazy/rare siding that you cannot find anywhere, you can and should ask for the entire house to be done. You will be charged some depreciation but seeing as siding has a very long life, were talking only a few % if the siding is really that new.

The OWNER of the vehicle is responsible! And I hope they have good insurance! They are liable for "reasonable" repairs to put whatever was damaged back in "fair" working order. Alot of times a repair company can take a piece or pieces of siding off your house in less conspicuous area and use them for the repairs. Then replace those with the new siding. Do you have siding in areas no one will ever see? Like behind a bush, tree, fence, raised porch, shed, or something like that? It is not "fair"
or "reasonable" to expect your whole house to be resided!

That is probably a grey area. Technically they are probably only liable for the physical damages however if your property value or your properties marketability will suffer, they should compensate you for that. I would insist that you just want your house the way it was. Tell them if they can find a company who can match the color perfectly then you are happy however if not, you either want the entire house re-sided or money for the loss of marketability. I once got an insurance company to give me money for "anticipated loss of value" because my car was not going to be worth as much when I got ready to sell it. I got an extra 1500.00 for this because I refused to go away until I got it. I told them that they could either buy it from me for the reasonable blue book value or give me the money I would lose. Squeaky wheels get the grease so be one!! Keep going up the ladder until you get someone who will give you what you want. If they don't ask them what agency oversees them that you can file a complaint with.

Yea OK.. like your really going to get your whole house resided. Thats just unreasonable. They may reside an area... or find a color that matches your current color of siding but absolutely NO WAY is your house getting resided.. that would do what insurance calls "betterment"- it would make yoru house better then before the accident.. and you are not owed for that.

They are only required to pay for the damaged siding, you should be able to blend it in pretty good, the painter will likely paint the whole side of the house, not just a small area.

I think the insurance company is responsible for repairing ONLY the damaged part of the house, however, they do make concessions from time to time. You may have to sue the mother if the insurance company will not bend.

In your siutation what MAY happen is they reside the house (or repaint it) and charge you depreciation as well. The insurance company is only obligated to put your property to the condition it was in PRIOR to the loss, however if this isn't possible the repairs are depreciated....you are not entitled to be put in a position that leaves you better off.

no it should be the other insurance company thats responssible if the other person hits you they should have to pay for the damage
