I was in a car accident and i received a letter from the other persons insurance saying that i was 50% right, when i was right. However, i showed my insurance agent the letter and she recommended me to go to a small claims court to ge the rest. Well, right now i dont know where to get the police report at because the copy i had said something with Arcadia and my insurance agent said that i go to temple city to get it? So, i am confused. Also, when i do get the police report, which small claims court do i go to, since i live in El Monte. The one in Arcadia or the one nearest me? Also, what do i need to prepare when i do go to court? In fact, the lady that was driving the vehicle for 89 yrs old and my agent said that she was supposed to get a ticket from the police b/c she was not authorized to drive at that age,is that true? I got a document with "traffice collision report" on it, is that the police report or do i need to get one@ the police station? The one i have is some kind of copy.

I would go back to your agent and tell her to handle the claim, that's what you pay her for.

You talk about cities that I have no idea where they are. I am surmising that you do not have collision insurance, and if I am wrong, then you should present your claim to your company for 100% of the damage, and let them subrogate against the other party (get their money back).

This is what you need to do;
1) get the police report - did the police come to the scene? If yes, then that city/town is the police department you go to. If it is too far, you can call them, and ask them how you would get the report. If the police did not come to the scene, then there is no report to obtain.
2) read the police report, does it clearly state that you are not at fault for the accident? If it is cloudy, then maybe 50% is what you are entitled to. I would need to know the facts to make that decision. Sometimes the police reports state that party A is at fault, but when you read the narrative, it swings closer to party B being at fault.
3) If you are clearly not at fault, thru police report, any witnesses that you may have, etc. then you need to contact the other parties insurance company and tell them that according to police report that their insured is at fault. Your agent should be helping you with that.
4) If it is not so apparent who is responsible, then you perhaps 50% is a good offer.
5) Your agent should be helping, as I said already.
6) Should you need to go to small claims court, then you file in the jurisdiction (location) where the accident occured. At the court there will be someone that will help you and tell you how to prepare for the hearing.

I have no idea if an 89 year old is authorized to drive, but so long as she has a license then she can drive.

You need to contact the police department that worked the accident, and depending on when the accident was a lot of departments don't have to provide you a copy until after 5 days. You should contact the police department, or the civil court in the county you live in to find the proceeding for going to small claims court.

I am going to suggest that you go out and get a good civil lawyer, he will know what to do to get the ball rolling for you. If nothing else apply for a court appointed lawyer, it is better than trying to understand the legal voodoo.

Request the one from the police station, it'll probably cost money.
