The truck seems to need some minor work, it won't pass smog. my question is will the dmv be understanding & not fine us or what should I expect. we cancelled our ins. on the truck when it was stolen,it was in the body shop about 4 mths. cause we neede bumpers (1988 Toyota) I got the ins. going again last week even tho we can't drive the truck.

I'm not sure what the question is. Is it not passing smog because it was stolen?

In the event of a stolen vehicle, before the insurance company will turn the car over to you...they will safety check it first to make sure none of the safety features were compromised, brakes, steering, etc. If it won't pass smog it might be related and if it is then the insurance will cover it.

What do you want them to be lenient about, the emission testing? That isn't going to fly, it doesn't matter that the truck was stolen, it still needs to be driveable, and legal. I don't know what kind of fine you think you will get, if you mean because you cancelled your insurance because the truck wasn't driveable, they don't care about that. Just get current insurance and make the repairs to pass smog test, if you can't pass the smog test, maybe it's time to let the truck go.

Well, what you should have done was registered the vehicle as inoperable and continued the insurance as such (you would see a reduced premium since you can't drive it). You may want to try to do this now, and as soon as you can drive it change the registration status back.
