If you are entitled to claim them on your return, go ahead and file and list them - you'll have to mail your return if he has already filed claiming them. That will start an IRS investigation if two people claim the same dependents.

If the children lived with their grandparents for more than half of the year, then it's possible that he IS entitled to claim them.

You could call the IRS and tell them what's going on.

Just file your tax return. If he's already filed, you'll need to file a paper return. The IRS will be in touch with you both and will request proof of your claim to the exemption.

The IRS won't discuss the identity of the other taxpayer with you but they will sort the issue out.

i ran into a similar problem what you do is file your return by mail and they will send both of you documents to verify who the child lives with if they live with you you may submit school records medical items and so on if this person has already filed you will not be able to file electronically and if you have already filed file an admenment the irs wont tell you the person who is using it but you already know who that is but you must file with that child to get the process going it will take a couple months but when he cant prove it he will have to pay back all that money plus interest. you will get your money have patience

I had the same thing happen back when I was married to my ex. We kept the three children even though the mother had custody. It didn't matter we kept the kids 11 months out of the year. She claimed them. We found out when we went and filed. I first contact the IRS and then I had to hire a lawyer. I had to sho proof that they lived with us. I hope this helped. Also,if you know anything that could help. Call DHS and turn his a$$ in. All you need is his name or residents.

bostonianinmo and Judy are both correct. You could attach a statement to your return to let the IRS know you believe the grandparent is illegally claiming the child, but the will figure that out on their own. If you attach proof that you are entitled to claim him, it may save you the trouble of doing so after the IRS discovers someone else claimed him.

call the IRS and indicate that Grandpa isn't suppose to claim the kids. They will nail him. He's committing fraud.
