I pay a non-registered provider to take care of my son, and pay cash $500/month and have no receipt. Can I claim it for child care deduction, if I only have her name and address but I do not have her SSN; is it still legal to claim this deduction?

In order to claim the deduction, you would require proof of payment (ie/ letter saying total amount paid in the year or receipts... in case of an audit), her name and SIN number. Without this, you will not be able to claim anything. Talk to her and see if she is declairing her income, if she is then ask her for the information you need. If she isn't, then you have a problem.

Whether or not she claims the income is none of your concern. Ask her for her SSN. If she refuses to give you her SSN, see the instructions for Form 2441, page 2, Due Dilligence section on how to proceed and still claim the Dependent Care Credit. Here's a link to the instructions: http://www.irs.gov/pub/irs-pdf/i2441.pdf You must make an effort to get the providers SSN or EIN but you can still claim the credit without it.

IF YOU DO FILE IT HAS TO BE BY PAPER NOT E-FILE. ADD HER NAME AND ADDRESS AND LEAVE THE SSN AREA BLANK OF THE CHILD AND DEPENDENT CARE EXPENSES (FORM 2441) THEN SEND THEM BY MAIL. THE CREDIT MAX IS $3,000. DOLLARS.
