I adopted my dog from a family back in 2005 paying $100 in cash for him. My psycho ex boyfriend is threatening to take me to court for custody of him. Now here's the thing. I accidentally left his papers at his condo when I left and he paid an emergency vet bill once. That all happened a year ago and since then I have taken him to the vet and gotten his Rabies, Bordetella, DHLP shots, along with grooming, etc....
I do not want him to see, or have visitations but he's threatening to hire a lawyer and take it to court. This is just really sad and it breaks my heart because he's such a momma's boy and deserves to be with me.
Any help would greatly be appreciated

Your ex-bf has NO rights to him, unless you SIGNED papers over to him.
Just tell him to take it to court..you don't care, as that will settle it once and for all...and he will have to pay all court costs, as the loser..
The tip about getting the county tags is good, too! That will go a long way toward proving your ownership, and you need to beat the ex to it..You could also have the dog micro-chipped. (they register it to your name when they do this) This cost $28 at my vet's.

If you dog is worth less than a couple thousand, which is what it seems to be (not in any way a slight to your dog, but you said you paid $100 for it and that's all I meant), your claim will probably end up in a small claims court. Different states have different monetary limits, but I'm sure that something worth $100 falls under any states' small claims courts. Anyway, in a small claims court, it is permitted (and probably, recommended) to represent yourself. As to whether or not you can legally lose your dog, YES, you can, depending on what the judge decides. But if your story you posted here is accurate and true, I don't see why a judge would not let you keep custody. Anyway, your exboyfriend is an idiot if he is going to "hire a lawyer" for a dog that's worth $100 when it's going to cost him more than that to hire a lawyer in the first place.

Even if the xbf took you to court.. Remember how much a lawyer costs, and it does cost to go to small claims court.. The judge is likely to, if anything at all,
ask you to pay th xbf for the emergency vet call, and
that would be the end of it.
He hasn't been paying for food, toys etc for the last year? He hasn't come to visit the dog in the last year?
It's likely the judge would realize that the xbf is either trying to get back with you or bug you.

First, can you get in touch with prior owner and get a statement of purchase from them? The fact that your vet's records will show you as the "caretaker" of the dog is a big help.
He is using the dog to get to you obviously. How wrong. He may be just calling yur bluff about getting a lawyer. Was this a bad breakup? Any history of abuse to you that others may know of?
Get together any documentation of dog's care. Possibly alert your vet's office of problem. It will take monies for him to get a lawyer and to find one that will even take the case. Sorry he is putting you thru this. Sounds like a control freak and using dog to get back at you or continue relationship.

if you have copies of the vet bills you are paying then you shoud be fine. If you don't the vet might pull them for you. If you can get in touch with the person you bought the dog from and get them to sign a affidavite and get it notorized you have an even better chance. I am sure you will win but I would put as much foot work into it as possible.

If the dog is in your name I wouldn't worry about it. Tell your x you'll see him in court and don't act like it bothers you to him. He is probably just saying this to hurt you. IF he does take you to court the judge will want to know what took him all this time and I'm sure the judge will see through him.If anything, maybe just maybe, if the dog is in your name, they might have you pay that vet bill you're talking about. Just make sure the jerk doesn't get the opportunity to steal this dog!!! I wish you ALL the best!!!

I'm not sure. But if the boyfriend didn't pay for anything for the dog he shouldn't. But you will need all documentation for the dog as proof. And so will he . Without that he p@#&ing in the wind. If he takes you to court be prepared. Chances are he might not be and it will go in your favor.

Your ex is pretty Stupid if he wants you take you to court over a dog, the dog likes you better, so he needs to be with you. If your ex wants the dog so bad, tell him, "Get a life, the dog likes me better. And if you're are planning to take me to court over a dog, get some money and buy a dog same breed and everything!!!! That's pathetic!!! We aren't together anymore, so technically, you don't hold possession over the dog, I do, He's mine, go buy your own!!!!!!!!!!!!!"

Let him take you to court and then when he loses the case you should counter sue for any court cost, lost wages and have a restraining order put on him. Then tell him to go get his own dog. He only wants it to hurt you.
