For example, if someone is selling a sealed piece of software in original packaging for $1, can I buy that? Or do I have to first somehow determine whether the seller is a licensed vendor?

No. But buying a stolen/forged product doesn't entitle
you to anything. If you buy Vista for $1 and it got a
"copied in china" stamp then you're pretty much on
your own.

No, it is not your responsibility to determine if it is stolen but it could very well be one of those copied versions they are making in Asia. Beware: I got a factory sealed piece of software from a vendor on Ebay who has great feedback and it fried my computer and my cell phone; all I could get back was the money I spent of the software disk.
