He dose nothing for her anymore, just thinks about her on holidays and b-days. I don't know if the courts will have a problem with that.

I don't think the courts will have a problem doing that for you , but he does have the right to know what you are doing whether he is in her life or not. Be the bigger person and let him know the decision you are planning to do b/c who knows he might try and step back in and be more of a father to her.
