I recently got a ticket but i don't know what this code means. The officer said that he had been on the "HOV" for a while and that i didn't slow down when i saw him. Can someone explain to me what HOV means. I'm possitive that I was going no more than 68mph because i had just barely gotten on the freeway and i was trying to get in the carpool lane. By the way, i live in southern california. Torrance to be exact. The officer said that i was going past 75 mph. I know this is not true because the freeway was packed but the cars on my sides were passing me. I was the one being passed and I was the one who got a ticket. Is there any way i can fight this ticket. I know i was not speeding. Please help. Thanks! Also, Does anyone know how much this ticket might cost me?

22349. (a) Except as provided in Section 22356, no person may drive a vehicle upon a highway at a speed greater than 65 miles per hour.

(b) Notwithstanding any other provision of law, no person may drive a vehicle upon a two-lane, undivided highway at a speed greater than 55 miles per hour unless that highway, or portion thereof, has been posted for a higher speed by the Department of Transportation or appropriate local agency upon the basis of an engineering and traffic survey. For purposes of this subdivision, the following apply:

(1) A two-lane, undivided highway is a highway with not more than one through lane of travel in each direction.

(2) Passing lanes may not be considered when determining the number of through lanes.

(c) It is the intent of the Legislature that there be reasonable signing on affected two-lane, undivided highways described in subdivision (b) in continuing the 55 miles-per-hour speed limit, including placing signs at county boundaries to the extent possible, and at other appropriate locations.

Whether you can beat the charge or not depends on the facts. If it is your word against the officer's, you might try traffic school. If you have a lot of time and effort to do the research there are books out there that can teach you what to do to try and beat a traffic ticket at court, but these tend to do little more than tick off a judge.

You might consider a trial by declaration first. if you lose, then you can always appeal and ask for a Trial De Novo (new trial) and get another shot - this time before a judge.

Also, "HOV" is "High Occupancy Vehicle" and these lanes are the commuter, or "diamond" lanes.

There is no way to fight it, because you do not have a defense. It is just as illegal to drive 68 in a 65 zone as it is to drive 75 in a 65 zone. The fine is the same, too, about $146 for any speed 1-15 above the limit.

You will probably have the option of going to traffic school

What is usually the punishment or fine for this? Will it be a misdemeanor or infraction? The speed was 94 in a 65 zone
