my son is 3 almost four and my daughter is 1 almost two their father hasn't seen my son since his second birthday and has never seen my daughter.

You must go through the courts. Sad to think a dad can just walk away.....my daughter has one of those kinds of dads too.....

It depends on whether or not he has paid child support for a certain amount of time and used his parenting time. These figures depend from state to state. Get a lawyer, you'll have to follow procedures for your state about abandonment. My sister in law had to post a notice in the paper and fill out some other paperwork through the courts to get it done.
