While the answer you will get most often is "they have to get it to you by Jan. 31", in reality if they don't and every last person in the company is thrown in prison for the rest of their lives, you still won't have your W-2.

The answer, straight from the horse's mouth is to refer to the link for IRS Topic 154, (W-2 What to do if not received). I hope this helps. Your state may have different rules, so check with them also.

Have to come from your employer. Contact them; if you've lost them, ask then to resend. If they haven't sent them at all, contact info at www.irs.gov will tell you who to call to get IRS to get after them. MIght also consider filing for an extention while things sort out.

Contact the employers. If they don't get them to you, call the IRS and file a complaint with the IRS. Usually a call from the IRS is all it takes to motivate a lazy employer.
