We were married for a last year, and from december we are separated. My wife sent tax form by herself without me. Does she can do it. She deduct house payments etc.. what I can do ? help please

GENERALLY, IT IS BEST TO FILE TOGETHER; HOWEVER, IT IS ALWAYS BEST TO FILE TOGETHER WHEN ONLY ONE SPOUSE IS EMPLOYED.

If you were still married as of the end of the year, and your wife has already filed a separate return, your only option is to file as married filing separately. Since she itemized, you'll have to also - you don't get a standard deduction.

The only other option would be to talk her into amending her return into a joint return with you.

Your filing status is determined by your status at the end of the year. Maybe you weren't legally separted by decree of divorce at the end of the year, but were you under separate maintenace? If so, your filing status is single.

Furthermore, allowable deductions, filing status, tax liability, etc. is not determined by who beats who to the punch. My suggestion to you is to employ a reputable Attorney AND CPA in order for you to maximize your benefits from this situation. If these deductions and the ultimate outcome is dependent on several thousands of dollars, then it can be used as a point of discussion in the divorce settlement. If its only concerning a few hundred dollars, forget about it and move on!

Your situation deserves more attention than Yahoo Answers.

Since she filed a separate return you must file a separate return as well. And since she itemized her deductions you must also itemize even if your deductions are zero.

If she is unwilling to file an amended joint return with you, you must file a separate return.

Your spouse can choose to file without you. You will have to file a separate return as well. Since she itemized, you have to itemize.

If she will not tell you what she itemized, you go ahead and itemize what you are entitled to itemize (such as your payments on the house etc.).

If your return is audited you won't have a problem as long as you can document that you paid the expenses you itemized.

If you are still married you must file as married. She can't file without you. Even if she is filing married separate, she has to reference you on her return.
