There are plenty of people who have complaints against Bank of America. Complain to the Better Business Bureau. The best thing to do is not bank with them. I've known of people trying to do this sort of thing to Wachovia via RipOffReport.com. You should complain there, as well.
I no longer bank with Wachovia because they charged me when I tried to cash a bad check from an eBayer... They charged to return the check and charged an "adjustment fee" to my deposit into my account. If you qualify to join a credit union, I'd advise it... they don't nickel and dime you to death like larger banks and they give higher interest rates, too. I'm only getting 3.5% APR on my savings account where I am now, but Wachovia's was pitiful. (I know that a money market account would be a better bet, but the money's only going to be in there temporarily.)

I HATE BANK OF AMERICA!! I've always said that B of A will get a class action law suit against them! I don't know how many times I was charged for talking to a bank representative rather than visiting an ATM or doing a transaction over the phone. Not to mention that they refused to let me withdraw money that I JUST deposited.
I will never go back to that bank, nor will I put money in Wells Fargo. My suggestion is that from now on, use a credit union.

As far as dirty tricks go, if BOA isn't the worst offender out there they are at least one of the most creative. It's bad enough we pay TWICE to use another bank's ATM. It's understandable that another bank would charge a non-account holder to use it's ATM but then when your own bank also hits you with a fee that's nothing less than greed. But as long as people just shrug their shoulders and pay it that will not go away.
But the worst thing they do is attempt to maximize their penalty fees. $35 is an absurd amount of money to have to pay for one overdraft. Even their overdraft protection is ridiculous. In addition to paying a monthly fee for that service they will hit you with a $20 fee if you ever have to use it.
My horror story is actually quite common. BOA customarily processes larger check and checkcard amounts first to increase the possibilty of overdraft. If for example you had $100 in your account and you wrote 1 check for $90 and three other checks for smaller amounts all totalling $150, they will process the $90 check FIRST to bring down the balance enough so the others will bounce. Each bounce is another $35 for them. So instead of one bounce for the $90 check they get three for the smaller ones. That happened to me once, $105 in overdraft charges. I called to dispute but they said no. I then asked when they recived the larger amount check and they gave me a date one day AFTER the others had arrived. So in essence they waited til they were all in and then proceeded to process the larger on first so the others would bounce. Underscoring all of this was a direct deposit to cover the amounts which cleared the SAME DAY, but which was not credited until after the checks were processed. Could they have avoided that for me? Of course. But it's money to them. Like they really need it. Pack of theives.

BOA took on a lot of Fleet's old garbage nickel and dime fees and such when they bought them a few years ago. Only ones who win in a class axn lawsuit are the lawyers, and that's when there is something valid to sue about. You don't have a prayer. Instead of getting mad, you should have asked them to reverse the fee because it was an honest mistake yada yada. Look around for another bank, there are other banks with more consumer friendly attitudes towards their customes.

I agree with the first answerer. Fight your fee. A class action is like slapping a dog, it might make you feel good to get the aggression out but you do not win. The lawyers will take all for your $35 you may get $0.035 because that is one percent while the lawyers will probably get the same $0.035 but multiplied by tens of thousands. they get a new car you get enough money to lose in the couch.

Forget the law suit, you signed the contract, you are held to their legitimate decision on when you must pay by. You paid late, period. Theses nothing more to it, maybe you should consider paying on time next time, or not charging so much to your credit card. My wife and i have bank of America, and we are perfectly happy with them.
