Is there any recourse for the father to gain some custody?

Whether the biological father and mother were or are married doesn't affect his parental rights. He needs to go before a judge and ask for rights, and if he truely is the father, and he is not unfit, he should be granted rights.

A biological father has parental rights as long as he has not signed them away legally!!

Unless he has signed to give up his parental rights or is seen as unfit by a judge, he still has parental rights!
