Dentist did a root canal but missed a root. He kept telling me the pain was natural and to keep waiting. Then after 6mo said I should see a peridontist about gum loss. Then sends me to Ondontist after saying i will lose the crown he did 9mo ago because of decay. Ondontist tells me he never completed the root canal and that was what made me unable to eat on that side of my mouth, etc, etc. I call to confirm with him whaat the Ondontist says and his office says that it is not his fault...

I am supposed to attempt a settlement through arbitration first. Do I have a case. It has really sucked bad for the last year because of this. I would like all my deductable back for the rootcanal and the crown since it had to be destroyed when the ondontist re did the root canal and finished the procedure. Also oi want to seek compensation for the stress and the considerable discomfort and steady pain and inability to eat anything on the right side of my mouth for over a year???

You do have a case. However, if they offer you a fair settlement through arbitration, your case would be settled right then. If you are not offered a fair settlement then you will have to go to court, which will take very long.

Often times, it is hard to get one dentist to testify against another. Do you have a lawyer? You could use one for the arbitration even if you don't go ahead with a court case.

I'd sue him for sure! In most states you can get at least $25,000.00 at arbitration...find a lawyer who will agree to a contingent fee...that way you won't have to pay anything until you win...and, then he will take his cut off the top of the settlement...most lawyers will want about 40% if the case goes to court; but, will usually take 30% or 33% if the case is settled at an arbitration hearing!

If everything you are saying is accurate, you will be entitled to at least part of your money back. Arbitration is the best way to go and the least expensive for everyone.

Huge settlements for pain and suffering contributes to the high cost of medical and dental care.

Have you already talked to a lawyer? You may have a case but be careful. Doctors know how to cover their asses, and have many ways of dealing with lawsuits. But whatever you decide to do, good luck.
