You can ask. it would be up to the judge and the jurisdiction you live in. Some judges may give you a break on the charge and some may not. You will not avoid the conviction by going active, but you may be able to get a somewhat lighter fine or sentence.

No, I'm currently Law Enforcement in Fl, and also in the Army Reserves Military Police. I have seen alot of guys try that route and it really didn't help their sentence. Now if you wanted to go active then go, but don't go active if ur not sure and just want to do it to help ur DUI. Good luck bro!

no you couldn't. A judge isn't going to care. If you don't want to be convicted of a d.u.i. then don't drink and drive you idiot.
Besides, having your license suspended by a court could effect your lmiltary job, either way you'd de screwed

Technically, that is illegal. If you can get the judge to agree to it, you can do it, but the military cannot lift a finger to assist you with it. They cannot talk to the judge, or the prosecutor, or anyone, it is a HUGE no-no. But if the judge or prosecutor calls the recruiter or CO and says, "hey is this guy actually signed up to go active duty", they can tell them "yes" or "no", that's all.

This happened to my brother during Vietnam, he had a DUI. in Kentucky and joined the Army, the court sent a tracer to locate him, when the Army sent back confirmation the charges were dropped and a letter sent to my Parents house notifying them of this change.

Nope if you go active and get sent to the sandbox they will await for your return to do anything. But you could easily get the double whammy from the active side.

I doubt it. I heard that quite a few bases are suspending your base driver license if you are convicted of DUI.
