Thanks for reading my question. I was in a car accident about a wek ago. It is not my fault, and the police confirmed that. Now my car still runs but I have a window that is open, and I'm worried about security and rain. The other driver insurance company is taking so long. What should I do. I am in florida by the way, and I am insured too. Should I let my insurance cover it and let them deal with the other drivers insurance? (Will this make my insurance rate go up?) Should I bring the car to a repair shop and get a rental car and let them reimburse me later? Thanks again.

let your insurance contact the other one ! i am in Florida also and had an accident 4 months ago my insurance took care of it within 2 days I got a call from other company and my wrecked car was taken care of I was given a rental also all at the cost of other insuring company !

dont NOT i repeat... do NOT get repairs and a rental on your own. No one on here can confirm or deny how this will affect your insurance coverage.. but they are going to know you were in an accident regardless.

Go through your own insurance company and pay your deductible.. they will go after the other insurance company to get your deductible back and they will send it to you at a later date.

P.S... the guy below is misinformed. Yes, of course you are the victim here. but you cant just "demand" they help you. They have to investigate as well as make sure coverage is in place.. some problems at their end that may delay the claim.
1) Maybe the guys policy is expired
2) Maybe an unlisted or excluded driver was driving
3) Maybe they disagree with liability
4) maybe their driver is not cooperating

Thats just the beginning... so give them a break. sometimes they cant help it.

First, I am glad you're ok. Even minor fender-benders are no fun. Really, what you do depends on whether you can wait. With that said, let me give you some insurance insight:

-You have the obligation to mitigate your damages. In regular-person terms, what that means is if you carry coverage for the loss and the other party is lagging...and you are worried about weather/safety/driveability of your car, you need to take care of it. Be sure you keep it somewhere safe and out of the rain since the other company is not going to be responsible for damage caused after the loss.

-As much as we wish it wouldn't happen, as another person said-there are varying reasons why it's taking so long.

-You would have to initially pay your deductible. A rental car will be provided if you carry rental car coverage. Otherwise only rent the car when the vehicle is in the shop being fixed, since the other carrier is only responsible for this charge for the vehicle's repair time. If you have to pay out-of-pocket-rent a reasonable vehicle. Additionally, the other carrier will not be responsible for extra insurance when you rent a car, since your coverage extends to a rental vehicle.

-Once your claim is paid in full by your insurance, they will make every effort to recover all funds paid out including yours from the other party. The first dollars they collect up to the amount of your deductible will be given to you first. They will then collect theirs, and finally any out of pocket expenses for you.

Best of luck! At worst, if you can wait it out you might want to see if you can catch rides until they sort it thru, and garage that car if it rains!

Even when its not your fault, you should contact your insurance company after ANY accident. Often times they cover you and seek reimbursement from the other person's policy.

Also if you had rental car insurance you could use it to get a rental while waiting for repairs.

It should not effect your rates assuming the other person had current insurnace sufficient to cover the damage.

You usually have to get three bids for fixing your car, but your car has special problems with the window situation. Call your insurance agent and get some information from them - you should be given the opportunity to get a loaner until the repair shop repairs your car - you are the victim here, so demand that the other guy's insurance company take care of you.

If you need to get your car fixed immediately you need to claim it thru your own company, pay your deductible and let them go after the other company for reimbursement. The other company does an investigation to make sure that their insured is at fault for the accident (the police report does not determine who is at fault for an accident). Due to the investigation it does take the other company longer to pay for the damages to your vehicle.

If you were my client, I would advise you to go thru your own insurance.

yes to all your questions except your insurance going up ...if you have a police report stating the other person was at fault ...don't forget to have the other driver pay your deductible as well!
