I just got arrested in East Moline, Illinois, for stealing my own car. Technically it belongs to my father, but I had, and always have had, his permission to drive it. There is no beef between me and him. Now they took the vehicle and charged me with a felony theft and tresspassing. I just got home from jail like ONE HOUR ago, so what's next? My dad is in full cooperation with me. And we plan to get the vehicle back asap if they will give it to me. We seem to think they wanted my cell phone because of some very sensitive information within and just "pretended" to arrest me for the theft of an imaginary vehicle. It's '96 red chevy s10 4X4. There are like forty million of them around. If I get the truck back and there is no cell phone inside it should I like REALLY start to worry then? What do I tell my lawyer (we called one at 5am and put him on retainer immediately). I am due in court to answer to fake-*** charges within 30 days. help? -john (rock island, il)

Any fruits of a false arrest is inadmissible for further prosecution. The information gleaned from the cell phone may point to some criminal activity but it will not be used in court.

Your attorney must show that it was false arrest first.

That story is a crock. Time for a reality check. Only the owner of the vehicle or someone responsible for the car may report it stolen.
I think you should ask your Dad why he reported it stolen. Don't believe it? Go get a copy of the report. See who's listed as the complainant. I would bet that Dad did it to tighten the reins a little. And why are you so paraniod about the phone?
My guess is that Jr. was getting a little out of control and Dad exhibited some "tough love" by having the car (and you) picked up. Hmmm....no fake charges here.
Been there done that many times.

Your car had to be reported stolen by someone and it sounds as if your dad was the only one to do it. If he states that he didn't know you had it and refuses to prosecute the charges will be dropped immediately. As far as the cell phone goes.....I don't know why you didn't take it with you to jail but if you didn't it will be listed on the tow sheet as property and will probably still be there.

Pipe Grampa is right, vehicles don't get listed as stolen unless the owner reports it stolen. What about this trespassing thing? You are leaving out important bits.

You're so full of **** that it's coming out of your ears. Vehicles cannot be listed as stolen unless the owner reports it as stolen. The police didn't just decide that the vehicle you were driving was stolen and jail you.

Try making up better bullshit.

Sounds like something very fishy is going on. If your father didn't report it stolen, and if there is no error found, then get sic that lawyer on them.
