In California, you can be arrested for being under the influence of anything. If you are riding a bike or walking down the street, Cops stop you and smell marijuana or find it on you, you are in deep s**t trouble. Been there. What about the Illegals immigrant?......Illegals? Get it!

You can still get a DUI while riding a bike in California. It does not carry the same punishment, and I believe it may actually be a penal code violation.... I am really not to sure on the specifics of this. You can be arrested for "Suspicion of being under the influence of a controlled substance". However, you have to be doing something pretty obnoxious to give the Officer reason to arrest you for that reason alone.

Absolutely even if it was from medicinal marijuana (biggest hoax a lawmaker has ever accomplished) or any other prescribed drug. I wish I could remember the code that deals with this but there is a ton of gray area with it. I will have to check through some of my paperwork form some drug related courses I took while a peace officer I remember talking in depth about this and California.

I can't quote what exactly the name of the law that the law enforcement uses, but I know you can be arrested for being under the influence of marijuana while riding a bike.
However, I only know that because my loser brother was busted for it... The catch was my brother was on parole. I hope that helps. :)
