Are you talking about property loss or bodily injury.

If you are talking about property loss, you will only be entitled to the cost of repairing your car and replacement transportation while your car is being repaired. This is assuming that you are the claimant rather than the insured. If the accident is your fault, you will not receive transportation replacement unless you have a rental car rider on your policy (which is an additional premium fee on your policy).

If your car is a "total loss" you will only receive "actual cash value" which is the current market value (in your demographical area) of your exact vehicle, including mileage and options.

If you are talking about bodily injury the standard settlement should be 3X the cost of your medical bills. This is what an attorney will tell you, however, it is rare that an insurance adjuster will readily agree to this formula. Keep in mind that your medical treatment must be reasonable and necessary for the type of injury that you are claiming.

If you have an injury, DO NOT sign any release forms until you have received all appropriate medical treatment. Once you sign a release form you will receive no further settlement dollars AND any future medical problems you encounter will be at YOUR COST.

It is the job of a good insurance adjuster to attempt to get you to sign a release form as soon as possible. If you feel that you are not getting "good faith" treatment from the person who is handling your claim, you should seek the advise of an attorney. Most attorneys who handle bodily injury claims do so on a contingent basis, which means that they do not collect any money from you unless you receive a settlement. The amount they collect depends on how far your legal action goes. For example they take a smaller percentage if you settle out of court and they take a larger percentage if you actually go to trial.

Of couse I could not answer your question without knowing more facts but I do know one thing for sure: it is in the insurance company's (not yours) best interest to give you the smallest amout possible that the average person is not intelligent enough to refuse. Contact a personal injury attorney immediately, it should not cost you anything. They will probably be able to get you a lot more that the insurance company would ever offer you if you were not represented by a lawyer. Then whatever the settlement is, the lawyer takes about 30% as a fee for getting you the money. Much better that settlement. Call an attorney immediately, (of course the insurance company will tell you that you do not need one).

Depends are if you have injuries or doctor bills.

I had an accient a few years ago and I went to the emergency room, and had therpy, chiropractor and massage therapy. After I was released from doctor's care, the insurance company totalled up all the medical bills, multiplied by 3 and sent the check to my attorney. The attorney takes one third of the total and gives you the rest. You are supposed to pay of the medical bills and the rest is yours for punitive damages. Some ins companies will pay the medical bills directly.

Assuming that you were not at fault, you would get the value of the vehicle at the time of loss, adjusted for condition, plus any medical expenses you had as a direct result of the accident, and perhaps some compensation for pain and suffering.

Uh.. if your talking about for injuries OBVIOUSLY it depends on what happened? Do you just have "whiplash" or did you break your back? DUH.. it depends on whats wrong with you.
