there are not enough funds in the account. The person that wrote it now lives in NY, I live in TN. How do I get my money from this check writer? I have tried several times to cash it but keep on being denied

If it's bounced that many times, it's not likely to go through. He obviously scammed you.

If this is someone that owes you money, you're only choice is to sue him in small claims court if you can't get him to send you a money order. I doubt he's going to put $3200 into his bank account at this point.

Have you checked with his bank to find out if the account is even open?

Never redeposit a rubber check as most banks charge you for the bounce too. . .
Send a certified letter demanding a Cashiers check for that amount plus any check bounce fees you've paid.
If you do not have the Cashiers check in 7 days ,
Report it to the police , as $3200 is a felony .
Advise the person that the check will be turned over to PD if you do not get the cashiers check.
If you do not get the $$$$ , file in small claims . . .
Once you win the judgment you can have their wages garnished or place liens on any property they own .

You have to try get a hold of him, hopefully you can and he will make good for it, if not you will have to take him to small claims court or try to have him charged for fraudulently writing a cheque with insufficient funds, To me it sounds like he has taken you for a ride and being he has moved its going to be a lot of problems getting your money, Good luck I think he has flu fed you. It's this type of person that makes it so no one will except cheques any more.
Good luck hopefully it will not cost you a fortune to get your money.

You can sell it to one of those check collection businesses, but they'll charge you a fee.

Otherwise, you're probably out of luck.
