Pull you over and not tell you why you were pulled over? I wa s in the car with someone who was pulled over (& arrested) we asked why and were never told. We ran no red light, there were no stop signs to roll thru, we werent speeding or swerving. I guess that brings me to my next question, are they allowed to run your license plates legally with no reason for doing so (I ask because i was told by one of my professors who is an attorney and a very good friend who is an attorney that they are not allowed to do it legally). Also, are male officers allowed to search and arrest women? Just asking because i'm not too sure how it works and before i move forward i would LOVE to get some info from a law enforcement official or an attorney who i dont know to see if there is any variation. I'm very shaken because it was a scarey situation, they had three cop cars behind us, one of whom was a DNR officer & had hands on guns . Hopefully i'll be able to file a complaint this week. Mkay, first of all to those who say that i wasnt a victim YOU dont know me, if I were NOT the victim then i too would have been arrested. I know the accused very well. The car was not stolen he told me so and allowed me to drive the car away. I called his Sgt and he said he would look into the file and tell me why, when he called me back, he still had no reason as to why. For the person who told me to READ the low, that's what i'm trying to do and why i'm asking people other than the atty's that i know, get your head out of your behind. She had a warrant for TICKETS! TICKETS! That she has PROOF that she paid. This has happened once before here and the person was let go withOUT having to even pay bail moneys. The proof that she had paid the ticket was in her wallet and she told him to look inside it he refused. No, they didnt have to tell me why they arrested her but if they want to run my license i want to know WHY. Some of you are stupid, i'm on here asking because I DONT KNOW!

@Ronald T, THAT is what my professor told me! Something about there having to be some reason for them to run the plate, they had none. The officers SGT even said that he is supposed to tell why we were stopped. It seems to me that they were looking for someone, a few minutes before we were stopped we saw 3 police cars behind someone else and they were out in FULL force. They city that i reside in isnt that big, so for that to be going on was very weird

@ LawOfficer... Wow, i'm so happy that you know me so well. How wonderful, i'm glad you are able to tell me who i am and what i have a problem with, because i had no idea. You are such a life saver. How about YOU worry about doing your job properly and not being corrupt, mkay. The cop was a jerk and so are you. Thanks for filling me in on me :)

The US has degenerated into a Police State. It began with the War on Drugs and the politicians are using the War on Terror to finish off what little rights to privacy we had left. Remember, in both cases it's to make us "safer." Yeah, right.

They can pull people over because of an inoperative tail-light and if they find a reason to bust you after that then they make sure the tail-light doesn't work after the vehicle has been impounded.

They trained to lie and in (kangaroo) court it's your word against theirs. So, basically, we're all screwed.

One explanation i received for being pulled over .
"MY PEROGATIVE" or however you spell it?
IF YOU ARE FEMALE AND ATTRACTIVE?
Chances are you will be pulled over. Chances are you will also not be cited.
Illegal lane changes (If your tire does or does not touch the dividing line ) are also a good one.
On the freeway weaving within your lane.
Car sounds a little loud.
You were waiting a little too long at that last light change . Hmmmmm . Heard that one also.
YES THEY CAN RUN YOUR PLATES .
NO THEY CANNOT PULL YOU OVER WITHOUT JUST CAUSE .BUT THEY ALWAYS HAVE A REASON .EVEN IF IT DOESN'T MAKE ANY SENSE.
A male officer should request a female officer to search a female suspect. But can do somewhat of a search for his own safety.
Your complaint will go nowhere . What you can do is complain politely in a letter to the Captain about the particular officer involved. Maybe have a few friends complain a few times and let the Captain decide.The Cop cars behind ....One is for back - up and the rest were not busy. Depends how many in car.
The thing is ? If you are in a vehicle and the driver is arrested. Depending on the violation , the occupants are also suspects and searches can be applied.
Driver has no license or has drugs . Or has warrant for drugs then car can be searched and people in it if a controlled substance is involved.

If she was stopped for outstanding warrants, that's all the reason needed. Even if the tickets were paid, sometimes that's not posted immediatly to the Law Enforcement Officers in-car computer. The NCIC or LEIN (Networks). It's a common mistake, and nobody is the victim.

Male officers are allowed to search females in my state, and arrest them OF COURSE. But in some cases if a female officer is available the male officer will ask for the female LEO to do the search to avoid conflict. Now, there is a BIG difference between a pat down and a search(thourough searches are done at jail; vaginal/anal/oral by female staff), and a DNR Officer is a Law Enforcement Officer, as ANY LEO is. Chances are if he/she had hands on guns, you or the "someone" you were riding with was acting aggressive or not responding to the Officers commands.

If you had 3 cars there, chances are the officer put in a request for those vehicles because of YOUR actions. Play ball, be calm, explain and present your information as requested. You'll get no where with your complaints if you had 3 sworn LEO's on site. I can tell by the way you communicate your problems you have a problem with "authority".

Contrary to what you have been told, officers do NOT need a reason to run a license plate. They could check the registration for every car they see if they want to. And if the plate check reveals warrants, that is plenty of valid reason to stop the car. Sometimes the computer will show outstanding warrants even if they have been recently paid. it will be ironed out in court. If the offender hadn't been a violator and gotten tickets in the FIRST PLACE then we wouldn't be having this conversation, would we?
An officer needs reasonable suspicion to stop a car. That means that he reasonably believes that the occupant is, has been, or is about to be involved in some violation or crime.
If you have a valid complaint, take it to the administration of that department. However, if you were not the person charged, then you may not be the one who needs to complain. Good luck.

First, yes, I run plates all day long. The courts say if I find a plate where the registered owner has a warrant or a suspended drivers license, I have probable cause to pull them over. I keep the community safe this way. I don't need a reason to run a plate.

If I want ID from the passenger, like in your case, I would simply ask. Since your friend had a warrant, I have two choices: 1. tow the car and you walk 2. find a driver that is licensed and get permission for them to take custody of the car. If you drove away, they decided on option 2. Consider yourself lucky to be able to save your friend hundreds of dollars.

Well you weren't driving so you weren't privy to the information, first off. AND Yes your tag can be ran for absolutely no reason whatsoever. Law enforcement are held to a certian standard and cannot use the information illegally nor can they pass it off to anyone for reasons not pertaining to enforcemnt of the law. Now if you had three police cars there something was definately wrong....how well do you know that driver? Was the car his/hers?? That person might have had warrants and again that would be none of your business legally. Male officers can search and arrest women. There is protocol set up for that. Why are you filing a complaint? Sounds like you don't have too much information. I mean you are not saying you were hurt or detained unnecessarily......I don't see a problem.

And you don't get your miranda rights read to you just because your are being detained. The Miranda i for investigative purposes. You may sit in jail for a few hours and never get Mirandized, if nobody wants to ask you questions.

To answer your question, YES, they are permitted to run anybodys license plates anytime. If the driver was pulled over and arrested it was because there was something wrong with either the car or the driver. (You misinterpreted what your professor told you - read the LAW)

Male officers can search and arrest either gender. They are law enforcement officers and that's what they do.

With three police cars, I suspect that the driver was not some little innocent boy that was being brutalized.....

Go ahead and file your complaint - it won't get you anywhere. What you should do is learn a lesson here and be careful who you hang out with.

First it is legal for a police officer to call in any license plate on any vehicle at any time for any reason. It is illegal to stop a vehicle without cause State of Delaware Trooper Donald Prouse v Stitz. A police officer must have seen a violation of the traffic or criminal code to stop a vehicle. Now in your case a venture to say that upon checking the license plate the owner of that vehicle was wanted on a warrant for a criminal action. Therefore the vehicle was stopped and the owner / driver arrested. The police are not required under any law to tell a passenger of a vehicle why someone in the vehicle was arrested.

Something sounds fishy. The cops just happened to pull over the car you were riding in, arrest the driver, and your wondering if you were a victim. Sounds like the police are guilty of doing their job.

yes they can go up to your car while your both driving, and he punches in your license plate number into a computer and if theres somethings suspicious like the car was flagged for being stolen then they can pull you over, however if your arrested you have to be read your miranda rights and why your being arrested.
