Depends on the situation. My mom and dad once got sick after eating oysters in a French restaurant when we were on summer vacation there; I ate from the same batch and was fine. Oysters are eaten raw and are notorious for causing food poisoning, even when they're fresh and handled well you can get a bad one in the bunch. We didn't even let them know, just chalked it up as an incident, related to the oysters rather than general hygiene.
But if a place looked crappy or I got sick from food stuff that wasn't known as high-risk, then I might call either the restaurant to complain or the health department to take a look around... 'cause I'd think they'd be far more likely to be at fault, I don't want others to suffer the same thing and while I wouldn't care to sue them for millions (you don't get much in my country anyhow even for serious stuff) I would like my money back or something.

Call the restaurant and the local Health Dept. and report you became sick after eating there. Tell them the date, what you ate, and they can advise you if it is an issue others have contacted them about.

First I would go to the hospital. Then I would contact the restaurant and let them know that their food made me sick. If they did not give me a refund, I would SUE!!!!

Funny you should ask. We ate Long John Silver's ( seafood rstaurant) last night and my husband has been ....well showing all the signs of food poisoningg since early this morning. I did call and let them know and I am getting ready to call the ER and see what I can do for him.

It hasn't happened, so I can only guess. Maybe I'd call and ask for the manager. Explain what I ate, and see if they could check it out or throw it out before someone else got sick.
I wouldn't sue.

Well, if I ate at the restaurant before and never got before, I wouldtake the loss and get over it. Everyone makes mistakes and sometimes, people just don't cook food properly. Why sue them. Have you ever made a mistake before? And if I got deathly ill from the food, well thats just my luck isn't it.

I would simply pay the check and NEVER go there again. I would also warn all my friends about that place. Word of mouth is a powerful thing.

This happened to me and my husband. We called and complained to the manager first and then we called the health department on them!
