No. I perform BAT on people for preemployment, post accidents, randoms, suspicious behahavior. Breath alcohol ratio is the same as blood alcohol. The first question I ask before running a BAT is have you had anything to eat, drink, smoke or chew in past 15 minutes?? If no, procede with test. If yes, we wait 15 minutes. It takes 15 minutes for alcohol from food, gum, mouthwash to dissipate. BAT tests for "drinking alcohol". If positive, must be rerun after additional 15 minute period--called a confirmation test.

Yes. Many products for cold/flu contain alcohol - the liquid ones especially. Also, some mouthwashes if used shortly before a breathalyzer may show a positive.
