It isn't. There are very few countries where the death penalty is still in force, and even there it's used selectively (or arbitrarily, if you prefer). There's also very little evidence that the death penalty actually serves as a deterrent - I know there's lots of people who won't like to hear that, but (i) very few murders are premeditated, and (ii) the strongest factor in deterring any kind of premeditated crime isn't the penalty, it's the detection rate - the more people believe that they'll actually be found and convicted, the lower the rate of premeditated crime.
The 'eye for an eye, tooth for a tooth' argument - which is Old Testament and somewhat overriden by a good man who suggested forgiving one's enemies - actually began as an injuction to *mercy* because the prevailing custom was to extract far more than an eye in return for an eye: so it was an injunction to be moderate in punishing those who have harmed you.
It's also the case that those states in the USA that have the highest use of the death penalty also have the highest murder rates, so you can't really argue the case for deterrence.

I disagree with that. The death penalty is used far less than lesser sentences such as life imprisonment. Plus, there are several different kinds and degrees of murder. I don't think you're taking that into account. Many times convicted murderers are back on the streets and killing again because the death penalty ISN'T used.

A number of states have outlawed the death penalty.
They don't support government murder, and war either.
They are more prone to support the welfare bum, the dead beats, the government give-aways. Then they want to complain about their taxes.

Because the constitution and the laws were inspired by the bible where God says: If you eliminate these types of people from among yourselves, These things will cease to happen.
He being our creator knew about genetic defects that sometimes cause horrible results. He also warned us that Satan's flesh & blood offspring were also on the planet with us.
