My neighbor died and it's empty. Its posted no trespassing. But I live here and I'm paying for the fence repair. Can I get in trouble for trespass, or arrested?

Typically there is a joint responsibility for the fence. Post that you want them to pay their share or you are willing to do it but will be going onto their land on [date]. Technically you are tresspassing but if you cause no damage, what neighbor's estate wouldn't be grateful?

Invite your neighbor to the fence for coffee or beer and let him know what's up so you don't get a dog bite in your behind from an un-suspecting home owner.

I doubt you can be arrested. Can't you let the township know what has happened and why the repairs are necessary. I'm sure there would be no problem.

If the fence is on your property than you can work on eithe
side of it, however, if the fence is on the property line, than
you cannot. It is against the law.
