My psycho roommate charged @ me with 2 knives, & I went to make a police report, & the police wouldn't let me make a police report because I have mental disabilities. They told me that "By law, I'm mentally unstable & incoherent." But in actuality, I'm mentally stable. I can't be too mentally unstable & incoherent if I have a college degree in Spanish-Liberal Arts, huh?

What do I do @ this point? Should a police officer be telling me such thing? This sounds awkward. I thought that ANYONE should be able to have a right to make a police report. Was what he said considered DISABILITY DISCRIMINATION? & can I sue the precinct?

yes you do have rights,call your local DHS or ask your MD
who you should talk to and get the ball rolling

How come you did not call the police to the scene? Why did you, instead, go to the police department?

If the officer refused to take a report for assault or brandishing, you can certainly appeal to his supervisor. However, none of this guarantees that a crime can be proven and will be prosecuted. You say he came at you with some knives. If your roommate denies the allegations, then they are left with your word against the roommate's. If there is some reason to doubt your credibility (mental health issues, prior contacts, etc.) then no DA would dare go to court on an unsubstantiated allegation.

So, talk to the officer's supervisor and ask for a report. If they won't take the report, then ask why not. You can then run it up the flagpole further to attempt to get some resolution.

I assume you have moved? If not, why not?

It is sad but it is true that a person with a mental disability isnt allowed to make a police report, unless it is as a witness or a perp in a crime matter. However by law things like terrets, OCD, depression and annorexia are considered to be mental disorders. Granted I dont see how having any of these things would effect someones judgements or actions in your type of situation. But to them it is classified as a mental dissoreder, and they dont have to take a report.

Hell your roomate could have went to the police right after that, and told them that it was you who charged him with the knives, guess who they would believe. Yep they would believe him and probably take you away. Thats the justice system for you, its a freakin joke.

I wish you could sue them for discrimination, but I dont really think it would stick. Go and talk to a lawyer who specailizes in police abuse, then tell him/her what happened, depending on where you live, you might be able to have that cops job and some wicked sweet money. The consultaions with lawyers are supposed to be free, and hey if you dont win, you dont pay. If you do they usually get 35 to 40% of what your settlement is, so aim high.

There the police they can and do anything they want and there's not much you or anyone else can do about it after the fact because who would investigate a report of misconduct, why the police of course. Oh and just get another room mate it's easy er.
