I have asked The Royal Bank of Scotland and The Bank of scotland for a copy of the Default Notice that they had said had been sent. Even thou this is now some 3 years old I was not able to get a cope. I never did recieve a copy in the first place from either banks.What are my rights ? Could I take the banks to my local county court ?If so how ?If they cannot supply a copy is it therefore possible to get the default notices removed from my creidt file?

That's indeed a strange scenario! The banks refusing to furnish copies of documents sent but not received by the clients, and clients sleeping on it for three years! If you've to return money to the banks and if they continue with what you claim they have failed to do, maybe good for you for the time being but be warned that they might come back with a vengeance and ask for all the money you owe them in one go!

The point of a default notice is that it is the first stage of enforcement action and has, by law, to be sent. If they take you to court for the money, you could claim they have breached the consumer credit act by not sending one (as you have not recd it, you could claim it was never sent) all they would have to do then is provide you with a copy, wait 28 days and then take you to court again.
if the money is now all repaid, you can write to the credit reference companies and they will put a note on your file to say the debt is settled (you would need proof of this if the bank havent already told them). But it wouldnt necessarily improve your credit rating as the default will stay on for six years,even if the debt has been paid.
