of personal injury claims are settled before they go to trial? Where can I check the figures out? They have not admitted liability yet. I fractrured my skull at work on a fire escape we had to use due to renovations, several building regs were broken.

I cannot answer on usa laws but in aust personal claims are settled some 80 %, for about 60% to 80% of what you would get in court, ( saves you some costs) but work related injury's bring about a hefty fine as well as settlement, so they are more keen to settle before it comes to court!

Your case is one you better consult a lawyer in your area on. Each state has differing percentages of out-of-court settlements. If you can prove the injury was caused by an unsafe fire escape, you will likely want to go after to owner of the building.

I do not recommend suing your employer unless absolutely necessary.

Reguardless, consult a lawyer and let the lawyer get you best deal possible, even if they take a percentage.
