the company that does our payroll, garnished 90% of my check and claims that they cant do anything about this incedent anymore! Felt I had no choice but to except it and was left to struggle during x-mas time. They heard me I made sure of that! Well here I am 2 month later and once again I find my-self being put in the same spot!!!!!!!! Please if any one has any legal suggestion's of how to address this situation so that I can not be put in this mess and maybe have this company feel the same as they have done to me or just simply answer to the errors they continue on making, so that they dont do this to any one else again, i would be so thankful to any ideas or suggestions.

Since the law states that only 50% may be withheld, I would start with the head of your HR Dept. If that does not correct the issue, I would discuss it with a lawyer. This happened to my husband & all it took was a $20.00 letter from a lawyer for us to get our money. I handle payroll & garnishments right now for our company & I can safely say that the fault lies with YOUR company!!

WEll, I used to work in payroll, and I can tell you that some heads should be rolling in that payroll dept right now!! They screwed up, and it is their job to fix it! They just don't want to because they have probably already paid the money forward to whoever you owe money to... they either don't want to have to eat the extra money that they took from your check, or they are just too lazy to make the required adjustments.

In most cases there IS something they can do about it, and if they refuse, you need to find out who they answer to and start going over their heads. Don't stop till you reach the top!!

Contact your state Attorney General's office and ask to speak to someone there. Tell them your problem and ask them what you can do as this company is in violation of your rights to be able to support yourself. I guarantee no company wants the Attorney General on them for something like this.

If it is by law illegal to take anymore than 50%, then go and see someone connected to where it is handled and demand a refund.

See a judge and get a writ.

sorry to say it, but take care of your debt. file bankruptcy, go to credit counseling, consolidate, or pay your bills.
