The Belmont CA code bans chewing tobacco or smokeless tobacco. Why did they ban it if the use does not create second hand smoke and no danger to the public?does this prove discrimination against people that use a legal product? And if they argue health care cost then we have to ban immigrants who sneak into the country and use the health care system.

And where does all that nasty stuff go once it's been chewed? On the ground for people like me to step in! That is more disgusting than the smoke in my opinion. Ugh! It's littering.

If someone spits, that can be against the law. No one wants to walk on spittle, whatever it might have in it.

And smoking in public places fouls the air. But smoking cannot be banned. This is America, land where you are free to taint your own lungs if you wish. The outdoor air is public property. I may not like your smoking down wind from me, but so long as we are both outside, I figure you have a right. In an outdoor stadium--that is another matter. Leave that up to the state and local government.

As for chewing tobacco, anywhere a person can carry a soda can, he or she can chew. It may smell a bit, but so what? What right do I have to stop someone else from doing something that does not affect me?

P.S. Cities and states may ban the sale or manufacture of alcohol, but they would be overstepping their bounds to ban its private consumption. For that matter you can legally make your own wine or beer in 48 of the 50 states.

uhh could it have anything to do with the fact that people have to spit the ugly stuff outsomewhere when done w/it? It might be agood idea to check out the websites below and take a look at what using chew tobacco or any other kind of tobacco can do to you and how to avoid this and have a longer and happier life. Don't be afraid to look at what might be in your future if you use tobacco.

Oh, just one teeny weeny more thing ..if you and others continue to use after knowing the hazards, would you please sign an insignificant silly little document... that says something that relieves all taxpayers from funding any hospital/doctors care or medicine or disability payments or nursing home care payments in the unlikely case you dont ummm ..have the resources or insurance to cover it at the time ?Sorry to trouble you all. carry on

They can ban it for the same reason that counties and cities can ban alcohol entirely. Such bans are legal, since there is no federal or constitutional right to those substances.

I don't think they should, because people should be allowed to poison themselves all they way, as long as isn't an area-effect attack on everyone else nearby.

It's a health risk to the user, isn't it? I personally think you have every right to use either--in the privacy of your own home, or in an establishment that allows it, which I won't visit if I know about it.

I think it's unreasonable to outlaw the use of tobacco at all when the sale of tobacco remains perfectly legal.

And where do you spit.the chaw......that is a petty crime..but a crime none the less....even putting it in a cup and putting the cup in the garbage is technically a violation of the non spit laws..
