Can Friend of Court issue a bench warrant and the police not have it on file?

My ex didn't pay child supprt the ordered him to pay or he would serve 15 days in jail. he didn't pay so bench warrent was filed in 2/6/2006 . then my ex wanted to see my daughter I told him to take care of his bench warrant he said he went to the police station and he has no bench warrant why is this? could this really happen In Michigan??????????????????????????????????????-*

I would think you would know him better than this. Did you ever consider the fact that he was lying?! Don't take his word for anything. Check with the police and/or court yourself, if this is, in fact true, then take the papers to the proper agency showing them why there should be a bench warrant and demand that they explain to you why they don't show a bench warrant, and you want this taken care of.

The judge is the one to issue a "bench"warrent.he does so from the bench for not being at trial.
sometimes there is a delay in getting the warrents distributed to the verious agencies.
