Someone owed me 250 dollars. He made out a check for that amount and then after I deposited it he stopped payment and it was sent back to me. I have tried to talk to him about it but he said if I take him to small claims court he will take me to court for forgey. He claims that I stole the check and made it out to myself which is a lie. the check has his signature on it for proof and somebody was there when he made it out to me. He is in the military and he just left to another country. How do I go about getting the money from him?

I can tell you something that works, i did it...Write a letter to his commanding officer demanding payment and write what he did in the letter...His CO will make him pay...Find out where he is stationed and the military will be able to give you a name and address to send it to....

You're in luck. If he's in the military, you just contact his command in writing, explain the situation, and enclose a copy of the small claims court filing.

Fraud is against the UCMJ, and the military FROWNS ON IT.

well i am not sure small claims court is the answer go to a recruiting officer for whatever branch of the military he is in and they can find his senior officer and he will take care of the matter or be dishonorably discharged proving what you have stated is true and you can prove it.good luck!

Normally you would go to Magistrate Court and swear out a warrant. Go there anyway and explain to one of the Court clerks your dilemma (that he is outside the jurisdiction of the Court and cannot be properly served). Ask them if they have any procedures in place.
