I recently went to court to enforce a child support order that was $8k behind. He had to pay me $2k from an account and has 3 years to pay back the arrears. Now it has been 2 months since the order, he has paid about 20% of his reg child support and not touched his arrearage payment that the court ordered. I can not afford to take him back to court and sometimes struggle to make sure my children have what they need but this deadbeat can afford to take my kids to Disneyworld and other lavish vacations because of his failure to take care of their day to day needs. He has had his DL revoked but parades into DHS and explains that since he drives for a living that he can not pay without it and they have reinstated them. How do I make him accountable, and remain relatively civil? I exchange the kids with them and do everything to the letter, I just don't see why he should be above the law, especially at the expense of my children. Any help is appreciated.

He's not above the law, the law is just very flawed and overworked. It is unfortunate, but you are going to have to go back to court every single time he violates his orders. State child support agencies are required to provide child support collection services to any state residents who request them. In spite of these efforts, state programs have been criticized for the child support they fail to collect. That is the sad part of the judicial system. The alternative would be to look into those services that claim they will collect your child support for you. I am only referencing them because I have heard of them, but cannot speak to their efficacy or individual integrity.

You can ask the court to have the child support payments taken from his pay. It is called a garnishment. He has no control over it at all, it is simply deducted and sent before his paycheck is even cut.

oh he thinks he's above the law... right now. thinks he knows all the tricks, does he?

hmmm...

first of all, if there has been no progress on the arrears, you have the right to call and request a hearing because of that.

you also need to apply some heat to the case, as well as write a letter...

1) call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?

2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, him only paying 20% of the child support, no progress on the arrears, yet can afford his trip(s) to Disney Land. tell them about his license being given back, no liens on his bank accounts, property, no warrants for his arrest for non compliance. ask them what they are doing about it. tell them you respectfully request that the state and federal child support laws be applied to your case.

keep the letter short, its more effective that way.

then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

the Regional FEDERAL Child Support Office fax number is on the right hand side of the webpage, after you've clicked on yoru state.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean.

even if you miff 'em off, just keep at them, until something is done about this and he learns he is not above the law, the children come first.

just keep at 'em.

Your mom has to bypass by infant help collections in order to get the %. help. that's not so that you may spend. infant help is for the care and feeding of a minor infant. that's to pay for portion of the employ/personal loan the custodial figure has to pay. that's to pay for portion of the relatives costs (electricity, gas, sewer, water, garbage, cable, information superhighway) the custodial figure has to pay. that's to pay for portion of the groceries the youngster consumes that the custodial figure has to pay for per week. that's not for a baby who has left the custodial homestead. by ability of doing so that you "emancipate" your self and make your self un-eligible for ANY infant help, including back infant help.
