If she's divorced it's legal, otherwise it's not.

No this is not legal she has to be divorced completely before remarrying i think. Once the divorce is final it is legal to remarry in the worlds eyes in this case.

That's committing bigamy in the states which is illegal. I'm not sure but i think its over 5 years imprisonment
