can you have the sole custody if the non custody parent behind childsupport and not seening his child?

It sounds as if you already have sole custody. If not get a lawyer and check into it, but you can't get sole custody because someone is behind in child support

Custody is determined by the presiding judge at your custody hearing. You can have sole custody, shared custody or joint custody. Child Support and visitation are separate issues and not paying child support is not a reason for someone not to see their child. Only the court can terminate the court ordered visitation rights or terminate parental rights. You should speak with your attorney to get a clear understanding of what the court has or will order in your situation.

the only time sole legal custody is granted by the courts is when the non custodial parent gives his rights up in the decision making for the child's benefit. most times you can get sole physical custody and joint legal custody. that is what is usually granted. but child support is not a reason to claim sole legal custody.

I think the only reason someone is given sole custody is if the other parent is completely unfit or uncooperative. No one wants to keep a child away from their parent even if they are not paying. I don't know your situation, but take it from someone who knows: if you try to keep your kid away from the other parent he/she will eventually resent you for it. If the other parent is not a good person let them figure that out for themselves. They deserve the right to have as many people love them as possible, even if you don't like them.

who is it that has sole custody? The non-custodial parent shouldn't have it. And certainly not if he's behind in his child support.

What kind of custody agreement do you have? Did you go through the courts?
