I bought my house five years ago, I have done
some improvements on it, and now am looking at working
in the back yard, My neighbor has a tree, growing at
an angle, that prevents me from putting up a five foot
fence on my property. Now the neighbor is not a very
nice person, his kids trample through mine, and
another neighbors lawn, they are not very
approachable, they are sometimes downright nasty
people. What are my rights, what would you suggest. Thanks.

...you may very well be able to make him cut down the tree...local ordinances determine that stuff...you've already mentioned his temperament....it Will get worse...are you prepared to hate where you live? to not go outside, because THEY'RE out there? to dread dealing with him? i mean, i know, i know...can't run you out/off your own yard...i'm just sayin', things get awful when you hate your neighbor....

I don't know about the legal side of things but I've just recently seen that same problem with a store backing onto a persons garden the tree was at an angle stopping the fence they got around it by fitting the fence either side right up to the tree then a small fence piece at it's base letting the tree itself be part of the fence. Your neighbours might be hateful but it's not the trees fault .perhaps you can trim the overhanging branches ?good luck anyway Denise

call the city see what the options are.You could put up a 5 ft fence but when you get to the tree just put in a 4 ft section on shorter or cut out the 5 ft section to fit the trees shape

Had this problem and you have the legal right to cut that tree to your property line. Just do it and when they take you to court you will be in the clear as we did.

Some states have different laws so be sure to ask for free legal advice from a lawyer.

Put a slot in the fence to accommodate the tree or trim the tree if possible.

You will need to check the laws and ordinances for your area. If nothing can be done I would build around it. Good fences make good neighbors!

Give him the benefit of the doubt. Ask him. Be nice about it.

I am not sure what your rights are but since its you that wants the tree removed, I think you should pay for it.

Why would he object? Give him a chance.

i think you are allowed to cut down any part of the tree that extends into your property, just as long as you don't take out the whole tree.

Don't know what state you live.. Your local building dept. should be able help...If neighboring children are a problem install razor wire...
