my boyfriend has residential custody of his 7 year old son. the mother has lost a total of three children to two different men. his company was going under, so he had to get a new job. he took a third shift position until a first shift one comes available at his new job. he has a responsible babysitter for nighttime, where the child has his own bed. the mother was proven unfit by the courts two years ago. she was proven unable to bathe the child, change the child's clothes, and put the child to bed at a reasonable time, amongst other things. she has a pending dcfs case against her for giving the child a knife unattended. she has never taken advantage of her visitation rights on holidays or the two weeks she is allowed in the summer. she moves in with different men every two months or so. very unstable. she has now hired a lawyer (the same one she had when she lost custody) and wants to go for residential custody. do you think she has a chance? should my boyfriend be worried?

Dad has a responsible sitter, for when he happens to be at work. Period. He is providing for the child's safety and needs, right? AND she has a pending case against her?
Then she hires the same lawyer that wasn't able to help her before (not that he should have helped her.. if she was endangering/neglecting the child to begin with).
No, I don't think she has much chance. Actually, sounds like the dad has good possibility to have her rights terminated totally.

Does she have a chance? Yes, as the courts unfairly favor mothers in custody disputes. However, your boyfriend can just about squash any chance she has with a good lawyer. Given the existing testimony against her, as well as the pending DCFS case against her, the case almost writes itself. The mother's lawyer will have a very hard time building a case that she has improved and is now fit to parent.

I did at the same time as my little ones were youthful so i'd nicely be homestead with them in the course of the day. certainly, i'd not want to do it back because i replaced into in undemanding words averaging 4 hours of sleep an afternoon for years.

There is ALWAYS a chance that...

That being said, I believe that your bf is safe. 1) doesn't sound like mom wants the "baggage". 2) any investigator finding the child safe and well-cared-for will close said case. 3) even IF...mom will need to prove that she is capable of care.

if she has been proven unfit the answer is no they would never give the children to her. so no he can relax.
