How do you get a private server on World of Warcraft? Also can you get banned for using one?

Well i saw a vid on youtube (yes most of my proof comes from YouTube) and a guy was on a private server and using a flying mount in Azeroth. i thought "that looks cool!" i just want to know. i don't have the link right now but i'll update it later.

It has a great selection of Private Servers available.

And, no you can not be banned for using a private server.
