Well this guy backed into my explorer with a backhoe, he was supposed to show up on the 14th and meet me at the auto body repair shop. He never showed up, now what should I do? He caused 1300.00 worth of damage to my truck. If I do take him to court what happens if he still doesnt pay?

This happened about 2 weeks ago, is it to late to file a police report? I was trying to be nice and give him the benifit of the doubt. My Insurance company wont go after him cause I have no collision coverage. Am I screwed?

Get pictures, get all documentation possible, contact every witness. Why was the backhoe there in the first place, who authorized the backhoe to be there, who owned the backhoe, was the driver the owner? You absolutely have to document everything ASAP. Get names, times, dates and make sure the information is accurate. Did you call the police? Was a report made? If not, do it now and demand a copy of that report. If you have to go to small claims court to recoup damages, you will have to provide proof so you better make sure it is completely documented right down to the day, hour and minute. If the backhoe driver was hired by a company, they would know where he was and when. If that is the case, the company is liable not the driver, but rest assured, they will take it out of his pay unless the company is bonded against loss. Go for it, but make sure you have the proof! Sounds like something straight out of Judge Judy! At least you have a name. Document...Document...Ducument, report!!!! You waited too long, probably. Now the Nut Ball can claim he didn't do it! Being nice just goes so far. Contact "People's Court" might see you on TV. MM is a cool judge.

Go to the police station and file the report. You also need to report this accident to your insurance company. Usually you need three estimates on your damage incurred from the accident. Between the police and your insurance, they will proceed to inform you what else to do. If you didnt have insurance, he still can be brought to court to pay for the damages. bettyk

Wow... you should have filed a report!! Did you at least get his name and insurance info? Call his insurance company and tell them what happened. Probably you are just screwed though. Good luck.

First you must contact the police and file a report ,to allow for the police to try and help.If the can locate the person based on your info you may beable to contact the insurance co that covers the back hoe.then contact them to file a claim.

He is at fault unless you were illegally parked in some fashion.
Take him to court, and they will make him pay. If he refuses, they can jail him, garnish wages, and possibly even reposses. Suspend licenses. It all depends on the court and how it goes.

Did you get info. on his auto insurance? If so file a claim. If he did not have insurance contact the attorney general of your state for information on how they can go after him.

Did you fill out a police report and exchange insurance information? If you did, just notify your insurance company that he didn't show up.
If you didn't bother with the police report and if you nor he have insurance.....then, you are out of luck.
