My fiance injured his shoulder at work last weekend. On 3/21/07, he got taken to urgent care for diagnosis and treatment. He sprained his shoulder. He was doing his normal duties, and his shoulder popped. He is in a lot of pain. He got a letter today denying his claim for worker's comp. Does anyone know if anything else can or should be done to try to fight the ruling? I don't know if I'm putting this in the right category, but if anyone knows, please tell me. Thanks in advance.

I know it can be appealed, but I guess my question was really is there any point? He was at work doing what he normally does, and as a result, he sprained his shoulder. The paper said that because he was doing his normal duties, not doing anything out of the ordinary at all, it didn't fulfill the requirements for the Workers Compensation Act. So, really, is there any point in appealling?

Generally, such denials can be appealed.

The process varies by state, but most have some administrative judge who hears appeals like this. Some states also allow for appeals to be filed with the courts, usually after all administrative hearings and options have been attempted.

You should contact an attorney licensed in your state that handles workers comp claims.
