Gitmo is not in the country of Cuba.

Gitmo is land owned by the United States government that is on the island of Cuba.

Saying Gitmo is in Cuba is like saying Alaska is in Canada because they happen to be next to each other.

Gitmo is US property, and the prisoners there are under exclusively US custody. US laws and US Constitutional protections apply -- as the Supreme Court has ruled TWICE so far.
