A landlord shall repay the amount received as a rent deposit in respect of a rental unit if vacant possession of the rental unit is not given to the prospective tenant. 2006, c. 17, s. 107 (1).

we were told by a landlord we cant get our depsoit back, looks to me like we should..

If you paid a rent deposit and he then rented the unit to someone else, you absolutely get your money back.

Is he trying to say it was some kind of an "application fee"?

What it says.

The landlord (person who owns the property) sahll repay (give back) the amount received as a deposit, in respect of (for) a rental unit.... IF the tenant is not allowed to move into the rental unit ("vacant possession is not given to the tenant") by a particular date.

If that is the entire statute, then it would appear you deserve your money back. However, judging by the way it was written and the language used, it appears as if there is more to this statute. I do not know the context of the whole rule, but this seems to be referring to the landlord choosing another tenant over you. In that case you would deserve a refund, but if you were the one to back out things may be covered by a different statute.

what this says is that if you pay a deposit for a rental property and then are not supplied that rental property by the owner then he must return your deposit. If, on the other hand, you paid the deposit and just decided you didn't want to move in, that's a different matter entirely.

I can't tell from what you wrote why you aren't in the place.

If the landlord isn't renting to you, then yes (rented to someone else, for example).

If you decided not to move in, I THINK not. I am by no means an expert.

I'm going by the "is not given to" part, which SEEMS to ME to mean if they aren't letting you move in, but not if you change your mind.

It means that you get your money back if he doesn't give you the place.
